Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and BedMade ("we," "us," or "our") governing your access to and use of the Kru mobile application, website, and related services (together, the "Services").

By creating an account, purchasing a subscription, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

You must be at least 13 years old to use Kru. If you are under the age of legal majority where you live, you may use Kru only with permission from a parent or legal guardian, who agrees to be responsible for your use of the Services.

You must provide accurate account information, keep your login credentials confidential, and promptly notify us if you suspect unauthorized access. You are responsible for activity under your account except to the extent caused by our breach of these Terms or applicable law.

Kru is a wellness and habit-building service focused on making your bed. Features may include camera capture, automated photo verification, streaks, reminders, achievements, mascot stages, and paid subscription features.

Kru is not a medical device and does not provide medical advice, mental-health treatment, therapy, or professional coaching. The Services do not guarantee any particular health, wellness, or behavioral outcome.

When you submit a check-in, Kru may temporarily process your photo through Google Gemini to assess whether the image appears to show a made bed. BedMade does not save the raw photo in its database after the verification request is completed.

Automated results may be delayed, unavailable, or incorrect. Kru may offer a manual override for a false negative. You may not submit unrelated, unlawful, infringing, or harmful material; attempt to manipulate verification; or intentionally include people, documents, or sensitive personal information in a photo.

You represent that you have the rights and permissions needed to submit any content you provide through the Services.

Kru may offer automatically renewing subscriptions, free trials, or promotional offers. The price, billing period, features, trial length, and renewal terms presented in the app at the time of purchase are part of these Terms.

Apple or Google processes purchases through the applicable app store, and RevenueCat may help us manage subscription status. Your purchase is also subject to the store's terms. Unless you cancel before the renewal deadline shown by the store, your subscription will renew and the store will charge your selected payment method.

Manage or cancel your subscription in your Apple App Store or Google Play account settings. Deleting Kru or deleting your Kru account does not itself cancel a subscription. Refund requests are handled under the policies of the store through which you purchased, except where applicable law requires otherwise.

You may use the Services only for lawful, personal, and non-commercial purposes. You may not misuse the Services, violate another person's rights, upload malicious code, probe or bypass security, interfere with operation, scrape or harvest data, access another person's account, use automated means not authorized by us, or reverse engineer the Services except where applicable law expressly permits it.

You retain ownership of content you submit. You grant BedMade a limited, worldwide, non-exclusive license to host, transmit, process, and otherwise use that content only as needed to provide, secure, and support the Services. For verification photos, this license ends when processing is complete, except for any rights necessary to address security, legal, or abuse issues.

If you voluntarily send us feedback or suggestions, you grant BedMade a perpetual, worldwide, royalty-free right to use them without restriction or compensation. This does not give us ownership of your personal information.

The Services, including the Kru and BedMade names, mascot, branding, designs, text, software, and other materials, are owned by BedMade or its licensors and are protected by intellectual-property laws. Except for the limited right to use the Services under these Terms, no rights are granted to you.

The Services rely on third parties such as app stores, authentication providers, cloud infrastructure, subscription-management services, and AI providers. Their products and services are governed by their own terms and policies. BedMade is not responsible for third-party services that it does not control, but this sentence does not limit any responsibility we cannot lawfully exclude.

Our Privacy Policy describes how we handle personal information. It is a notice about our data practices and is not incorporated into these Terms as a contractual promise beyond what applicable law requires.

We may modify, suspend, or discontinue features of the Services. Where reasonably possible, we will provide notice before discontinuing a paid feature during an active subscription period.

We may update these Terms from time to time. We will post the revised Terms and update the effective date. If a change is material, we will provide additional notice when required by law. Your continued use after the revised Terms take effect means you accept them; if you do not agree, you must stop using the Services.

You may stop using Kru at any time and may request account deletion as described in the Privacy Policy. We may suspend or terminate your access if you materially violate these Terms, create risk or legal exposure, misuse the Services, or if we discontinue Kru.

Provisions that by their nature should survive termination will survive, including intellectual-property, disclaimers, limitations of liability, and dispute provisions.

To the fullest extent permitted by law, the Services are provided "as is" and "as available." BedMade disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and quiet enjoyment. We do not warrant that the Services will be uninterrupted, error-free, secure, or perfectly accurate.

Some jurisdictions do not allow certain warranty disclaimers, so some of the above may not apply to you. Nothing in these Terms excludes any warranty or consumer right that cannot lawfully be excluded.

To the fullest extent permitted by law, BedMade and its owners, officers, employees, affiliates, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or use, arising from or related to the Services.

To the fullest extent permitted by law, BedMade's total liability for all claims arising from or related to the Services will not exceed the greater of (a) the amount you paid for Kru during the 12 months before the event giving rise to the claim or (b) $100 USD.

These limitations do not apply to liability that cannot be limited under applicable law. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

Before filing a formal claim, you and BedMade agree to try to resolve the dispute informally for 30 days. Send a written description of the dispute and the relief requested to chadzarett@gmail.com. This requirement does not prevent either party from seeking urgent injunctive relief or using a small-claims process where eligible.

These Terms are governed by the laws that apply to BedMade in the jurisdiction where it is organized, without regard to conflict-of-law principles, except that mandatory consumer-protection laws in your place of residence continue to apply. The courts with lawful jurisdiction over BedMade will have exclusive jurisdiction, unless applicable law gives you the right to bring a claim elsewhere.

No arbitration agreement or class-action waiver is included in these Terms.

These Terms and any purchase terms shown at checkout are the entire agreement between you and BedMade regarding the Services. If a provision is unenforceable, it will be modified only as much as necessary and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them in connection with a reorganization, merger, acquisition, or sale of assets.
